Was the visa fee an unlawful executive overreach or a necessary fix to protect American workers?

The executive branch simply does not have the authority to impose massive new fees without congressional approval. Immigration policy must be made through proper legal channels, not through executive overreach. This ruling protects the rule of law and the tech industry's access to skilled workers.
Republican narrative
The H-1B program has been abused for decades, artificially suppressing wages and locking American workers out of high-skilled STEM jobs — the $100,000 fee was a necessary fix. One judge blocking this reform doesn't erase the real harm done to American workers by employers gaming the visa system.
