The Facts

  • Supreme Court judge J. Rademaker ruled on Monday that a state-wide mandate for face masks in indoor public spaces was unconstitutional.

  • NY Gov. Kathy Hochul, a Democrat, reintroduced the mandate in Dec. 2021 after state COVID cases began to soar.

The Spin

Progressive narrative

There could be irreparable harm to public health if masks are no longer mandated at a time when NY is still grappling with Omicron. J. Miller made the right decision to grant a stay until Gov. Hochul can appeal her case on Friday.

Conservative narrative

J. Rademaker was right to deem the mask mandate unlawful and unconstitutional. Hochul and the Dept. of Ed. tried to create confusion by lying about the motion to stay before it was granted.
