Judge Tosses Nirvana ‘Nevermind’ Child Pornography Lawsuit — For Now

Spencer Elden's lawsuit against Nirvana has been dismissed.
Elden, who appeared on the band's iconic 'Nevermind' cover at 4 months, claimed he was a victim of child sexual exploitation.
The lawsuit was dismissed with "leave to amend," allowing Elden to refile by Jan 13.
Elden's parents weren't fully aware of what the picture would be used for, and were paid minimally. It's unfair that everyone except Elden and his family made tremendous money off it.
Elden has profited off the album cover for 30 years, recreating it several times and conducting numerous interviews. Filing a lawsuit after three decades is clearly a money grab.
