The Sentencing Council of England and Wales has published new guidelines requiring courts to specifically consider pre-sentence reports for offenders who are of an ethnic, cultural, and faith minority, female, or transgender among other categories.
Justice Secretary Shabana Mahmood has written to the Sentencing Council expressing strong opposition to the guidelines, and requested an urgent reconsideration, while also announcing a review of the Council's role and powers.
The guidelines, set to take effect in April 2025, were developed through consultation beginning under the previous Conservative government, who Justice Secretary Shabana Mahmood has claimed did not raise objections during the consultation process.
The guidelines address documented disparities in sentencing outcomes and provide courts with necessary information to ensure fair treatment. Pre-sentence reports are tools for understanding individual circumstances and do not predetermine sentences, while evidence shows minority offenders consistently receive longer sentences for equivalent offenses.
The new guidelines create an unacceptable two-tier justice system with bias against straight white men, undermining the fundamental principle of equality under the law. The Justice Secretary either knew about this policy or was asleep at the wheel, allowing differential treatment based on ethnicity to become institutionalized in the justice system.
