Garcia’s decision is a decisive victory for freedom of religion against those who would seek to curtail it. As the judge rightly ruled, SB 10 is an egregious violation of the Establishment Clause and clearly favors one religion over others. The courts must go further, however, and prevent all ISDs in the state from enforcing this blatantly unconstitutional law.

Conservative narrative

The Ten Commandments are not only the bedrock of Judeo-Christian morality, but also the ideals and historical heritage of the U.S., which is why Texas voted to pass SB 10 to honor that legacy. As SB 10 is state law, it is the obligation of school districts to follow the bill’s stipulations, or face legal consequences for disregarding the will of Texan voters.
